Warranty
Sisu Plunge LLC guarantees to the original consumer purchaser that the products and component parts are free of material and workmanship defects within the specified period below:
- Tub Warranty: Residential (12-Month) or Commercial (6-Month) – Your Sisu Plunge is warranted against water loss due to defects in the cooler, blisters, and cracks of the interior surface of the shell due to defects in workmanship or materials for one year from the original date of purchase. Items that are NOT included under the warranty include dents, slight warping, scuffs, scratches, discoloration, fading, non-sticking graphics, wear to skid pads, or owner negligence.
- Chiller Warranty: Residential (12-Month) or Commercial (6-Month) – Specifically the pumps, control system and water purification are warranted against malfunctions due to defects in workmanship or materials for one year from the original date of purchase. Items that are NOT included under the warranty include damage to the chiller caused by freezing conditions, improper maintenance, improper water chemistry, or owner negligence.
Note if the temperature in your area drops below freezing, the chiller, pump (and/or plumbing system) will likely crack and break. Please monitor your Sisu Plunge daily when the outside temperature is below freezing. It is the owner’s responsibility to protect the components from the elements.
This Limited Warranty is void if Sisu Plunge or its designated representative determines that the product has been subjected to negligence, tampering, misuse, or damage/failure due to installation of aftermarket parts that are not genuine Sisu Plunge branded Parts & Accessories. This disclaimer includes, but is not limited to filters, UV-C bulbs, filtration systems, repair parts and other accessories. Genuine Sisu Plunge brand Parts & Accessories are built to our highest standards of quality, durability and performance, and they are designed to work with your Sisu Plunge to ensure optimal performance and function.
WHAT YOU MUST DO
To make a warranty claim for a product, you need to contact Sisu Plunge or distributor from whom you purchased it, accompanied by the original sales receipt as proof of purchase and a written description of the defect. If you purchased the product directly from the Sisu Plunge website, you can reach out to us via email. Please ensure to include your order number and purchase date while contacting us at Support@SisuPlunges.com
To obtain support in the event of a defect covered by this Limited Warranty, reach out as soon as possible and use all reasonable means to protect the product from further damage. Upon proof of purchase, a designated service representative will correct the defect subject to the terms and conditions contained in this Limited Warranty. There will be no charge for parts or labor to repair the defect, although providing access to affect the repair is your responsibility as the product owner.
WHAT WE WILL DO
At its own discretion, upon receiving notice and proof of purchase, Sisu Plunge shall determine (1) if the claim is covered under the terms of the Warranty Limitations, and (2) if a root cause analysis session between the owner and Sisu Plunge is required. If the warranty applies, Sisu Plunge will contact the owner to create a resolution plan for the issue. Sisu Plunge will NOT provide labor for repairs as services under this warranty. This warranty is not transferable.
WARRANTY LIMITATIONS
Limited Warranty is void if: Sisu Plunge or its designated representative determines that the product has been subjected to alteration, neglect, misuse or abuse, damaged in an accident, or freight damage caused by the common carrier; any repairs have been attempted by anyone other than a designated representative; or if the failure is caused by accident, acts of God or other causes beyond the control of Sisu Plunge. Neglect, misuse and abuse include any installation, operation or maintenance of the Sisu Plunge other than in accordance with the instructions contained in the owner’s manual provided with the Sisu Plunge, including but not limited to the failure to maintain proper water chemistry and chemical balance and the use of abrasive or improper cleaners or non-genuine parts and accessories. The Sisu Plunge owner accepts liability for repair work performed by anyone other than Sisu Plunge or a designated Sisu Plunge representative.
LIMITATIONS ON IMPLIED WARRANTIES
This Limited Warranty takes the place of all other warranties, express or implied, in fact or at law. All warranty service must be performed by Sisu Plunge or its designated representative using authorized Sisu Plunge parts. No agent, dealer, distributor, service company or other party is authorized to change, modify or extend the terms of this limited warranty in any manner whatsoever. Sisu Plunge will not be responsible for any statements or representations made in any form that go beyond, are broader than, or are inconsistent with any authorized literature or specifications furnished by Sisu Plunge.
LIMITATION OF LIABILITY
You expressly agree that your use of, or inability to use, the product is at your sole risk. The products and services delivered to you are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Sisu Plunge, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
INDEMNIFICATION
You agree to indemnify, defend and hold harmless Sisu Plunge, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States.
DISCLAIMERS
SISU PLUNGE AND ITS REPRESENTATIVES WILL NOT BE RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, and shall not be liable for any injury, loss, cost or other damage, whether incidental or consequential, arising out of any defect covered by this limited warranty, including without limitation, loss of use of the product and cost for removal of defective product even if Sisu Plunge was advised of the possibility of damage, and water damage. The liability of Sisu Plunge under this limited warranty, if any, shall not exceed the original amount paid for the defective product.
Coverage under this limited warranty shall commence as of the original date of purchase and the duration of such coverage shall not extend for any reason whatsoever beyond the stated time periods. These disclaimers shall be equally applicable to any service provided by Sisu Plunge and its designated representatives.
LEGAL RIGHTS
This Limited Warranty gives you specific legal rights. There are no warranties applicable to Sisu Plunge products except as expressly stated herein or as implied by applicable state and federal laws. You may also have other rights that vary from state to state. Some states do not allow limitations on how long an implied warranty lasts, disclaimer of certain warranties, or the exclusion or limitation of incidental or consequential damage.
